NCAA penalties extend to 10 FSU sports

The Florida State football team will vacate an undetermined number of wins, serve four years' probation, and face a reduction in scholarships and other penalties due to what the NCAA described Friday as "major violations" from an academic cheating scandal.

Nine other programs were also penalized -- baseball, men's track and field, women's track and field, men's swimming, women's swimming, men's basketball, women's basketball, softball and men's golf -- and face the same sanctions. Overall, the scandal involved 61 athletes. Football coach Bobby Bowden would have entered the coming season with 382 career victories, trailing Penn State coach Joe Paterno by one win on the all-time list. The sanctions will force him to forfeit all wins during which ineligible students competed in 2006 and 2007.

It is not immediately clear how many wins Florida State will have to vacate. Dennis Thomas, the vice chair of the NCAA Committee on Infractions and acting chair for the FSU case, said only one ineligible player would have had to participate in a game for the entire team record to be vacated. Still, Thomas said the NCAA had no evidence the university knowingly played ineligible athletes.

Florida State is considering appealing the sanction that would force the Seminoles to vacate wins.

"We believe that the NCAA confirmed that our investigative efforts and our self-imposed penalties were appropriate," Florida State president T.K. Wetherell said in a statement Friday. "We already began implementing our self-imposed penalties. And we will begin implementing all but one of the NCAA's additional sanctions.

"We just don't understand the sanction to vacate all wins in athletics contests in which ineligible student-athletes competed because we did not allow anyone who we knew was ineligible to compete. Our position throughout the inquiry was that as soon as we knew of a problem, they didn't play."

In November 2007, Florida State and the NCAA agreed that athletes who had received "improper help" would be suspended for 30 percent of their seasons. According to the Orlando Sentinel, officials interviewed 75 individuals, and 39 admitted receiving improper assistance in an online music course. Roughly two dozen football players were suspended for the Music City Bowl, which FSU lost 35-28 to Kentucky. The Seminoles also suspended about 10 players for the first three games of the 2008 season.

FSU officials and players were under the impression those athletes had already served their punishment, but Thomas said on Friday that the instant a player cheated in class -- regardless of whether school officials knew about it -- he became ineligible, and if that athlete played in a game, it must be vacated. That could cost FSU games from 2006, when the academic fraud began.

"They are ineligible at the time of that violation until they are reinstated," Thomas said. "If they participated while ineligible, obviously the games they participated in will have to be vacated. The trigger is if those 61 individuals obviously as identified by the institution committed academic fraud. At that point, they rendered themselves ineligible."

The football team will be limited to 83 total scholarships in 2008-09; 82 in 2009-10; and 84 in 2010-11; the maximum usually allowed by the NCAA is 85. Florida State self-imposed the loss of the two scholarships for 2008-09, and will self-impose the loss of three scholarships for 2009-10. The NCAA added an additional loss of scholarship from the maximum in 2010-11.

The committee stated this case was "extremely serious" because of the large number of student-athletes involved and the fact that academic fraud is considered by the committee to be among the most egregious of NCAA rules violations.

Florida State's probation extends through March 5, 2013.

"I must say that Florida State did a great job in cooperating with the enforcement staff in accumulating all of the information that was required," Thomas said. "Yes, Florida State did self-report. They did an outstanding job. We have to give Florida State University credit for that."

The NCAA determined that a former learning specialist, academic adviser and tutor gave "improper assistance" to Florida State athletes who were taking online courses. According to the NCAA, the former learning specialist typed portions of papers for at least three athletes and also provided answers to an online psychology course quiz by instructing another athlete to complete the quiz on behalf of the athlete enrolled in the course.

shit must've been pretty bad for the NCAA to come down THAT hard on a major program. they do this all the time with the Northwest Missouri A&M State's , not with the top programs. I guess Bowden will be retiring sooner than he anticipated.

Jack Markell is ready to legalize sports betting in Delaware. The ramifications across the political landscape could be significant.

Markell's plan might be at odds with the NFL, but he's more worried about a $700M budget deficit.

During his campaign for Delaware Governor last fall Jack Markell often hinted that, if elected, he'd support sports betting in his state. Now that he's got the job, Markell is done hinting.

ESPN The Magazine has learned that sometime next week, according to a statehouse source, Markell will introduce a proposal which, for the first time in more than 30 years, makes gambling on sports legal east of the Mississippi River. The plan, which could be approved by the state legislature as early as April, would likely be operational come fall, just in time for the NFL season.

Markell's proposal calls for a statewide sports lottery that only allows parlay bets. In a parlay, gamblers have to get two bets right in order to win. It's an idea that has been brewing in Delaware for a while, long before the economy imploded and the state found itself with a budget shortfall of $700M. In fact, a proposal to allow gambling on sports died in the state legislature last year, when then governor Ruth Ann Minner made it clear she'd veto a resulting bill.

The newly elected Markell, who has spent the past several weeks listening to proponents of gambling as well its opponents, is much more of a pragmatist than a betting revolutionary. He hasn't been to Vegas in nearly 15 years and almost never hits the race track/casinos (called racinos) in his home state. But the way he sees it is this: Delaware already allows horse racing and slots. And with the state currently $700M in the hole, offering the Pats minus-six over the Jets when bettors come by to drop a nickel in the slots isn't amoral. As he told me a couple months ago, "you can't really be half-pregnant."

Delaware, along with Nevada, Montana and Oregon, is one of four states that has long had sports betting laws in its books, exempting it from the 1992 Professional and Amateur Sports Protection Act, a federal law which banned states from getting into the bookmaking business. While Montana and Nevada still support sports gambling and Oregon only recently shut down its sports lottery, Delaware hasn't toyed with it since a failed run during the 1976 NFL season.

Markell is banking that the return of betting will help close his state's budget gap. According to the last National Gambling Impact Study, commissioned by Congress and released a decade ago, as much as $380 billion is bet on sports every year. In the ten years since then the Internet has not only increased the opportunity for sports betting, but the interest as well.

Markell expects the lottery to bring in at least $50-$100M in revenue through betting on games, increased handle at the racinos and higher food and beverage sales. He'll also propose that an unspecified number of locations, such as sports bars around the state be allowed to sell sports lottery tickets. He's hoping to develop a study of table gaming and eventually push for multiple casinos in the state. Essentially, he wants to turn his state from a local betting Stop-N-Shop into a full-fledged gambling destination. Sports betting is a lynchpin in his plans, which doesn't thrill leagues like the NFL.

"Our policy on this issue has been consistent for decades." NFL spokesman Greg Aiello wrote me in an email. "We have been an active proponent of federal and state legislation that prohibits the spread of legal sports gambling. We do not want our games used as bait."

"To allow betting in Nevada and three other states is discrimination against the rest of the states. We have to do something. If you go to Atlantic City on Super Bowl weekend there won't be anyone there." - NJ Senator Ray Lesniak

Governor Markell's spokesman Joe Rogalsky had no comment on the expected announcement.

Once upon a time supporting any form of betting was considered one of the third rails of American politics. Pols were better off saying they hated puppies, Christmas and the Star Spangled Banner. But that's changed in the past fifteen years, as riverboat and Native-American casinos have become as ubiquitous as interstate exits.

The economic crisis is only making elected officials more aware of how much the government can make by betting on gambling revenue. A recent study by PricewaterhouseCoopers reported that the United States stands to earn $52 billion over the next decade by taxing, rather than policing, Internet gaming sites, mainly those focused on poker. That news prompted Congressman Barney Frank (D, Mass.) to announce that, later this month, he'll propose a bill overturning the Unlawful Internet Gaming Enforcement Act of 2006, which bars banks and credit card companies from making payments to known online gambling sites. The law has made it difficult for many betting sites to do business in the U.S.

While sports betting is still the one form of gaming considered taboo by most lawmakers, Markell's move will have nationwide ramifications. When Congress passed the sports betting ban in 1992, only a handful of states allowed gambling of any kind, not including lotteries. That total is now 37, including Connecticut, New Jersey, New York, Pennsylvania and West Virginia, five states that either border Delaware or are less than a day-trip away.

All of these states compete for the betting dollars of people in the densely packed Mid-Atlantic region up through the Northeast corridor. In fact, New Jersey—which has seen gambling revenues in Atlantic City erode as the Internet and neighboring states encroached on its territory—is desperate to get a piece of Delaware's likely action. Later this month, NJ State Senator Ray Lensiak says he will file a federal lawsuit claiming the 1992 sports betting ban is illegal. "To allow betting in Nevada and three other states is discrimination against the rest of the states." Says Lesniak. "We have to do something. If you go to Atlantic City on Super Bowl weekend there won't be anyone there."

Chances are they'll be in Delaware.

Floyd Mayweather Jr., who hasn't fought since December 2007 and retired as the undefeated pound-for-pound king in June, is planning to fight again -- possibly as soon as July 11 -- two sources with knowledge of the situation told ESPN.com.

"He is coming back. I've been around him. He's ready to dance again very soon," said one source, who recently spent time with Mayweather and has known him for years. "He's itching to go. The way he sounded, he is willing to take on whoever they throw in his face. He would do the [Manny] Pacquiao-[Ricky] Hatton winner, Shane Mosley, Juan Manuel Marquez. The only one he doesn't have an interest in is [a rematch with] Oscar De La Hoya. But in Floyd's mind, he knows there is one Godzilla, and that's a fight with Pacquiao."

Mayweather has been working out regularly in his Las Vegas gym, sparring and is in great shape, according to one of the sources.

Before Mayweather fights one of the big names, both sources said Mayweather's team has talked to HBO about the availability of July 11, the network's date for that month's edition of "World Championship Boxing."

Mayweather, whose last four bouts, and five of his last six, have been on HBO PPV, has expressed an interest in fighting on HBO rather than pay-per-view for a possible tuneup bout ahead of a possible fall fight with the winner of the May 2 Hatton-Pacquiao bout.

HBO, however, would have to come up with a substantial license fee to make it work, so it remains to be seen if a bout on the network could be made. A summer comeback fight for Mayweather, who has been dogged by IRS issues, could also go on pay-per-view instead.

HBO also has another dilemma. One of the reasons it has not committed to giving Main Events and Golden Boy Promotions the July 11 date for a fight that is being negotiated between cruiserweight champion Tomasz Adamek and former two-division champion Bernard Hopkins is because it is also talking to Mayweather about the date, said one of the sources, who has knowledge of HBO's issue.

"They don't want to upset Floyd and they hope the situation resolves itself," the source said.

HBO president Ross Greenburg was tight-lipped on the matter.

"Not only do I have no comment, it's premature to discuss," Greenburg told ESPN.com on Wednesday. "There are no real substantive talks."

But has Mayweather or one of his advisers contacted HBO about a summer fight?

"I'm not confirming or denying that," Greenburg said. "I'm not going to comment. Call me back in a few weeks."

Talk about a Mayweather comeback has swirled for months.

In December, Mayweather (39-0, 25 KOs), who turned 32 on Feb. 24, told his advisers, Al Haymon and Leonard Ellerbe, that they were free to listen to offers for fights.

Earlier this month, Mayweather's father, Floyd Mayweather Sr., who trains Hatton, told media on a teleconference to discuss Hatton-Pacquiao that his son's ring return was imminent.

"Of course, there is no question about it," Mayweather Sr. said. "He's trying to get a fight right now, as we speak. He's gonna fight again."

Haymon could not be reached for comment. Ellerbe did not return numerous telephone messages or e-mails.
